Employee Benefits: Defines various types of employee benefits such as health insurance, retirement date, paid vacation period, and more.

Performance Review Cycle: Mentions the rules and regulations under which performance is reviewed.

Termination Clause: Defines the rules and regulations under which the employer or employee terminates the employment agreement. It also defines whether a notice period is required and, if applicable, what the length is.    It also specifies the terms for returning a company’s equipment.

At-will Employment Clause: It mentions that the employer has the right to terminate an employment agreement for any reason without informing or warning the employee or providing legal grounds. Similarly, employees can resign for any reason without informing or warning the employer. One thing you should know is that an at-will employment clause is not legally allowed in all countries.

Non-disclosure Agreement: This clause defines restrictions on employees from sharing any confidential information, trade secrets, or intellectual property details for a specific period.

Non-compete Agreement: This clause states that after retirement or resignation, employees cannot work for an employer’s competitor for a specific period.

Non-solicitation Clause: This clause states that employees are prohibited from soliciting clients or workers during the period of employment. In some cases, they are also prohibited for a certain time after termination or resignation.

Types of Employment Agreements:

There are different types of employment agreements that can depend on the individual needs of the organisation, such as clarity, formality and legal enforceability. Some of the most common Employment agreements are listed below:

Permanent Employment Contracts:

As per the suggested name, the permanent employment contract has no fixed end date. It is an open-ended and full-time Job role arrangement. Under that contract, the statutory rights of the employee are more secure. This type of agreement provides more security and basic benefits to the Employee. In most cases, these agreements are offered to employees for regular working hours, such as full-time and part-time. Such a type of agreement will continue in effect until the employment term ends or either the employee or the employer decides to terminate it. 

Fixed-term Employment Contracts:

The terms of the agreement play a significant role in a contract. Such a type of contract refers to a type of arrangement, like periodically or project oriental requirement. Fixed-term employees are also entitled to equality with permanent employees on the basis of wages, hours, and statutory benefits. 

Fixed-term employment contracts commonly apply for a specific period which is predefined in advance. In most cases such type of contract can be used for a certain period of time when the needs of employees and rational or some specific project. A fixed-term contract can be used for a particular time or project. However, it contains a clear clause related to the project work that must be achieved within the contract period. Under this contract, the employee is entitled to get the benefits same as a permanent employee. However, it may affect in allowing leaves of absence and receive other financial benefits.

Probationary Contracts:

As for the suggested name, this type of contract is made for a particular time, such as 3 to 6 months. Under this contract, there is a specific clause mentioning the contract duration, extension rights and the notice period, if it’s applicable. 

Independent Contractor Agreements:

Independent contractor agreements are not covered under the purview of an employer-employee relationship. It is a different form of agreement under which independent contractors provide their expert services to the organisation and receive monetary compensation on specific terms. Under this contract, the independent contractors are responsible to the organisation for their exclusive work, which is agreed upon to be completed within a specific duration.

Other Types of Agreements:

Written Employment Contract:

A written employment contract describes the outline of the rights, rules, and regulations of the contracting parties. This type of contract is created in writing and signed by the parties, either in digital or print form.

Implied Contract:

In an implied contract, typically, the employee receives some introduction or documentation related to their job, which the employer expects the employee to follow. Let’s understand with an example: Suppose an employer gives their organisation’s rules and regulations handbook to the new hire, And aspect is implied that the new hire will work under these rules and regulations, which are provided by the organisation. Basically, such types of contracts are not commonly acknowledged or signed by the parties.

Oral Contract: 

When the contracting party enters into a contract via an oral or verbal agreement, it is called an oral contract. Under this contract, the employer states the rules and regulations, such as the period, start date, and scope of work, etc. If we talk about the enforceability of such a contract, it is difficult because of the lack of a written agreement. However,  verbal contracts are also legally binding to the parties under the law.

Drafting an in-depth contract is beneficial for contracting parties such as employers and employees. If we talk about employers, it reduces risks and provides significant evidence which protect a wrongful termination claim. It also provides protection to the organisation for the enforcement of confidentiality and obligations by employees when they are employed, on leave, resigned, or terminated. 

If we talk about employees, a well-crafted employment agreement provides them with security, such as compensation, job role, and the legal procedure before termination.

We can say that it is not just a copy-paste template. It has a meaningful role for the contracting parties, such as the employer and employee. It outlines rules, regulations, obligations, terms, and condition which is legally binding on the contracting parties. It also protects a right to the parties in the event of wrongful practice in the workplace.

Not only that, but it also protects the rights and obligations under the contract between the parties. If anyone tries to escape their duty, role or obligation, it can be enforced by the law.
